Nespresso is currently having to deal with a lawsuit in which one of its most important and benchmark products within the brand is being affected. The famed Vertuo Next is having defects which come from the factory. This defect is mainly based on the fact that when brewing coffee, it often uses more water than is required and, as a result, the machine and the coffee can no longer be used normally.
Denise Fashey-Ramirez has filed the lawsuit and directly accuses the company of selling a product whose functionality is not optimal and, moreover, the company has been aware of this problem since the presentation of the coffee machine in 202.

Plaintiff Denise Fahey-Ramirez claims Nespresso’s Vertuo Next coffee machines, marketed as the most versatile model for the popular Nespresso Vertuo brewing system, are defective.
Fahey-Ramirez argues the alleged defect causes the coffee machines to develop problematic water leaks that do not allow the brewing process, rendering them ununot usuable. It can be seen that this is a contradictory circumstance as they are apparently selling an efficient, state-of-the-art product, but in the end it does not work well at all.
“Contrary to Nespresso’s representations, the Devices are designed and manufactured with an inherent defect that results in water leakage and compromises the ability of the machines to operate as intended,” the Nespresso class action alleges. Fahey-Ramirez wants to represent a nationwide class and Florida subclass of consumers who, during the applicable statute of limitations, purchased a Vertuo Next coffee machine that leaked. It is a great act to help all the people who may have experienced the same situation, where their coffee machines are not efficient at all.

Fahey-Ramirez argues Nespresso has been conscious of the leakage defect since the machines were presented to the U.S. market in 2020 but has continued to sell them despite addressing the problem. Consumers, at the same time, have for years reported the coffee machines fail after restricted use — often shortly after the expiration of the one-year warranty — yet Nespresso has not reached to publicly acknowledge the defect or offer adequate remedies, the Nespresso class action alleges.
“Through records of (customer) interactions alone, Nespresso has been made aware of the pervasiveness of the Leakage Defect and their customers’ unhappiness,” the Nespresso class action exposes.
Fahey-Ramirez claims Nespresso is guilty of unjust enrichment, breach of express warranty and breach of implied warranty, and in violation of the Magnuson-Moss Warranty Act and Florida Deceptive and Unfair Trade Practices Act. he plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of monetary, treble and statutory damages for herself and all class crew.
